Introduction: The Frank Ski Kids Foundation is offering this opportunity to youth (ages 13-15) only. By participating in the competition, each entrant fully and unconditionally agrees to and accepts these Official Rules.

Eligibility: Open only to legal residents of the 50 United States (and the District of Columbia) who are 13-15 years old. Subject to all federal, state, provincial and local laws and regulations. Odds of winning in this particular competition depend on the number of eligible entries received for the competition.

Timing: The Competition begins at 7:00 a.m. Eastern Time (“ET”), May 9, 2008, and ends at 11:59 p.m. ET, May 16, 2008, (the Competition Period).

How to Enter: Go to http://www.frankskikids.org and follow the links and instructions for entry. After you have submitted the required information, you will receive one (1) entry into the Competition.

For all entries: LIMIT: one (1) entry per person during the Competition period. All entries must be received online during the Competition Period. All entries become the exclusive property of the Frank Ski Kids Foundation, Inc. and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Competition Sponsor. Competition Sponsor is not responsible for lost, late, incomplete, invalid or unintelligible submissions, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

Decisions: Prize Decision: The Prize Decision will be conducted in accordance with these Official Rules on May 23, 2008. All decisions will be conducted by the Competition Sponsor. Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. If a potential winner cannot be contacted within two days (48 hours) after the first attempt to contact him/her or if he/she fails to complete and return all necessary documentation for travel within the required time period, an alternate entrant will be selected in his/her place at random from among all eligible entries received.

Prize: Ten (10) Grand Prizes will be awarded to selected eligible entrants. The prize for which each entrant is eligible for entering for frankskikids.org is a roundtrip for one (1), economy class ticket on Air Tran with non-stop service from Atlanta to Miami and a roundtrip for one (1), economy class ticket on Tame Air from Miami to Manaus. In addition, accommodations will be provided for four (5) nights at Ariau Towers and two (2) nights at Embassy Suites Hotel, inclusive of ground transportation, taxes, fees, meals and beverages.

All trip and prize details (including, but not limited to hotels and/or transportation) will be designated solely by the Competition Sponsor, and may be changed without notice at any time based on Sponsor’s sole discretion.

All entrants must have the same origin and destination (Atlanta, Georgia) and must travel together at all times. Potential winners not residing in Atlanta, Georgia are solely responsible for transportation to and from Atlanta. Winners are responsible for procuring adequate documentation for travel. Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination. Any expenses not specified are the sole responsibility of the winner.

Publicity: Except where prohibited, participation in the Competition constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.

General Conditions: Competition Sponsor reserves the right to cancel or modify the Competition if any factor beyond the Competition Sponsor’s reasonable control impairs the integrity of the Competition, as determined by Competition Sponsor in its sole discretion. In such event, Competition Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of impairment. Competition Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of the Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Competition is a violation of criminal and civil law, and, should such an attempt be made, Competition Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Competition Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Medical Requirements: All winners will be required to submit to and pass a complete physical examination by a licensed physician. Winners must be free of contagious, infectious or incapacitating conditions, that pose a significant risk of substantial harm to the health or safety of the other travelers and that cannot be eliminated or reduced by reasonable accommodation. Winners must be medically and physically capable of completing the required physical activities as a traveler.Winners must be available and medically and physically capable to receive Yellow Fever vaccination paid for by the Frank Ski Kids Foundation.

Limitations of Liability: Competitions Sponsor is not responsible for: technical failures of any kind, including but no limited to the malfunctioning of any computer, cable, network, hardware or software; the unavailability or inaccessibility of any transmissions or telephone or Internet service; unauthorized tampering in any part of the entry process or the Competition; electronic or human error which may occur in the administration of the Competition or the processing of entries; or any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition.

Disputes: Entrant agrees that: any and all disputes, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, other than the administration of the Competition or the determination of winners shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
